The Mey Letters covers this period and that of his son James, and state very clearly that this Sir James died in a debtors prison in Kirkwall in 1732.

Facts:

Sir James Sinclair of Mey (died 1732) had a natural child to the sister of the Laird of Stirkoke in 1721.

John Sinclair of Stirkoke (died abt 1706) had at least two sons:
a. Francis
b. George

Francis Sinclair (son of John) disponed Stirkoke to his brother, George in 1710, as he had no sons.

Conclusions

Francis Sinclair of Stirkoke died in or around 1710, meaning George Sinclair was Laird of Stirkoke in 1721.

From this, it follows that the sister of the Laird of Stirkoke had to be a sister of George Sinclair, thus a sister of Francis Sinclair and as such, a daughter of John Sinclair (died 1706).

Final Conclusion:
Sir James Sinclair of Mey (died 1732) had a natural child to the daughter of John Sinclair of Stirkoke, who died about 1706.

Burkes Peerage states that this Sir James had only one son - perhaps they mean he had only one surviving son? The Mey letters make it very clear that there was more than one son living whilst Sir James was in Kirkwall.

James had a relationship with Unknown SINCLAIR Of Stirkoke.,¹ daughter of John SINCLAIR Of Stirkoke ¹ and Jean SINCLAIR,.¹

This is one of the sisters of George Sinclair of Stirkoke (died 1744). He was the son of John Sinclair who married Margaret Sinclair, daughter of Sir James of Mey.

Possibly Frances who married Bernard Clunes.

The kirk sessions show that in 1721 a sister of George Sinclair of Stirkoke was pregnant with the child of Sir James Sinclair of Mey. Arrangements had been made to have the child removed from the county at birth. At this point, Sir James was in a debtor's prison and had been for some time, so it's difficult to see how the couple could have had an affair, yet the heir to Mey was still quite young, and one of Sir James employees did make haste to Kirkwall, where Mey was imprisoned, to apprise him of the news regarding his mistresses child.

Still, there are anomalies within the account as given by St Clair. It would be of great help to view the original kirk sessions for this.

Burkes Peerage states her name was Margaret whilst St Clair's of the Isles states her name was Barbara in one account and Margaret in another - probably she was known as both at various times.

Whichever her name was, Barbara and Margaret are one and the same person - a daughter of Sir James Sinclair of Mey.

There is rather a large problem with this daughter. Burkes Peerage states she married Francis Sinclair of Stirkoke, however it is also stated that this Margaret Sinclair married Francis' father, John! She cannot have married both father and son.

St Clair's has to be wrong in stating that John Sinclair of Stirkoke married Margaret Sinclair, daughter of James Sinclair of Mey, as the dates do not tally, and it would also create a situation where the same woman married both father and son (her own son if St Clair's is accurate!) From this it would seem that Margaret married the son, Francis.

Margaret married Francis SINCLAIR Of Stirkoke.,¹ son of John SINCLAIR Of Stirkoke ¹ and Jean SINCLAIR,.¹ Francis was born after 1680 and died about 1710.

Margaret's Marriage Details : This couple had a curious relationship! They were:
half 2nd cousins once removed; and 4th cousins once removed; and 5th cousins.

Francis disponed his estate to his brother George in 1710 (according to St Clair's of the Isles, it was 1610 - obviously a typo), as he had no sons, only daughters. Presumably he did this as he was dying. His wife does not appear to have died, so there would be no other good reason for him to assume that he was never going to have sons.

Other papers state that Francis Sinclair was a natural son of George, 5th Sinclair Earl of Caithness, and that he married Anne, eldest daugther of Patrick Sinclair of Ulbster.

These two accounts do not reconcile in any way.

"According to Henderson, David Sinclair of Broynach had two children to his wife, a daughter of William Sinclair of Dun, plus a number of illegitimate children to a servant called Janet EWING / EWAN. They were David Sinclair a soldier who married Margaret MORE / McKAY, Donald Sinclair who went to sea, and two daughters. David & Margaret had children James (died1788), in Reiss, & John (alive 1767). This latter James tried twice in court to claim the Earldom of Caithness, when it was up for grabs in 1765, but failed because he was unable to prove that his father David was legitimate. It should be realised that in Scotland at that time a marriage legitimised previous issue, plus issue could be legitimised by charter. When Alexander Sinclair, 4th of Murkle, died in 1765 the Committee of Privileges (in Parliament) awarded the Earldom to William Sinclair, 6th of Rattar, who thus became the 10th earl of Caithness.
In 1891 David Sinclair at Bellarine Victoria Australia and others made out depositions in support of a court case in relation to a claim by David of Broynach's descendants to the title of Earl of Caithness. The claim was unsuccessful. The depositions outline an ancestry for David of Bellarine back to Donald Sinclair 'the sailor', a sea captain who owned his own boat and who was a son of David Sinclair of Broynach. It seems that our Sinclair ancestors in 1891 were still nursing the hurt of missing out on the title in 1767, although by 1891 they were not able to state exactly the link from Donald the sea captain to David of Broynach. If there was a link, then it seems reasonable to suggest that Donald the sea captain with his own ship and Donald the illegitimate son of David of Broynach were one and the same person.
Unfortunately, Henderson's list of children to Donald who went to sea doesn't match the list of children to Donald 'the sailor' outlined in the 1891 affidavits. Henderson gives the children as an elder son, daughter Anne who married Alexander WILLIS a merchant in Banff, and four other daughters, all of whom except Anne were dead by 1767. Roland St CLAIR's work states that Donald the illegitimate son of David of Broynach and Donald the sailor were identical. Roland ST CLAIR's list of issue to Donald is similar to the list of issue to Donald given in the deposition by David SINCLAIR at Bellarine.
A further complication is that a claim was put in for the title circa 1891 by descendants of William Sinclair, a supposed son of Donald the Sailor. William does not appear in our David et. al.'s depositions except in the form of a denial of knowledge that such a Wiliam ever existed, but that if he did exisit, then he must have been illegitimate." - Peter Dillon, New Zealand.

St Clair's states that George married twice and had several children but does not differentiate the children of each marriage. Perhaps Henderson? Isobel, daughter of Patrick of Ulbster, was known to be his second wife, but the name of his first wife has vanished.

Due to the debts left by his father the estate was heavily indebted and the rights were acquired by Patrick Sinclair of Ulbster, who assigned his rights to John Sinclair (4th of Assery) in 1675, and Sir George Dunbar, who assigned his rights back to George, and to his sons John and Patrick, in 1682.

Was believed to have died in France, having been taken prisoner whilst travelling to Edinburgh for his marriage, however an entry in "Chamber's Domestic Annals" states that he made his case known to the Scottish Privy Council and was released in exchange for a priest, Mar David Fairfoul. What became of him after that seems to be unknown, however it is assumed he died prior to 1676 as he did not inherit.

This is the most likely candidate for William Sinclair of Lieurary, or else his son. Although St Clair's does not note a son named William, it is most likely that he had one. Not all his children are noted in any one genealogy, and as there are at least three sons, one of his sons will have been named after him. Also missing from his list of children is a James Sinclair, named after his father.

The founder of the Baptists in Caithness was Sir William Sinclair of Keiss, who belonged to the Dunbeath family, and was, properly speaking, baronet of Dunbeath. His lady was a daughter of Sir James Dunbar of Hempriggs. On embracing Baptist views, Sir William went to London, and was there formally baptised, and admitted a member of his adopted church. He commenced preaching in Caithness about the year 1750, and continued to do so with great zeal for the space of fourteen years. He formed a church at Keiss, over which he regularly presided as pastor. In 1765 he left the county and went to Edinburgh, where he died two years afterwards.

Kenneth was a captain in Queen Anne's navy, and the West Indies on service when his father died in 1705. He seems to have remained in the Navy, for in 1711 it is related that in his own ship alone, a 46-gun frigate, he engaged no fewer than eight French privateers at once, and after desperate resistance was taken prisoner with five bullets in his body.

Unfortunately for Kenneth he joined the Jacobite rising and was imprisoned and his estates and title forfeit. After being released from the tower, he went abroad and became a flag officer in the Russian navy.

An excerpt from an Edinburgh newspaper of 3rd March 1716 (after the disaster of Sheriffmuir) says: "120 gentlemen of the Horse army, with whom were Lord Duffus, Sir George Sinclair, General Ecklin, &c, rode with all speed to Burgh (Burghead) in Moray where they embarked in open boats for Caithness, who did not know how to dispose of their horses, upon which General Ecklin immediately shot through his heart, and 15 more followed his example."

Prison: joined the Jacobite rising, 1715 or 1717. After the Jacobite's failed he fled to Sweden, but was captured in Hamburg and imprisoned in the Tower. His ttitle was attainted and estates sequestrated. The Estates were then claimed by the Earl of Sutherland who claimed possession under the Act by which "forfeited lands, holden of any Subjecy Superior, were granted to the Superior remaining loyal".

He was freed in 1717 without trial.

Kenneth married Charlotta Christina SIOBLAD,¹ daughter of Eric SIOBLAD Governor Of Gottenburg ¹ and Charlotte Regina PALBITZKI,¹ on 30 Mar 1708. Charlotta died in 1771.

James was a lawyer, an advocate, and after becoming a baronet in unusual circumstances, changed his name and started a new line, untainted by loyalty to the Stewarts. He managed this by marrying an heiress - Elizabeth Dunbar, only child of Sir William Dunbar of Hempriggs, in Caithness.

Although St Clair's leaves this person unlinked to any particular family, he states that John's son, Alexander was the great grandson of Francis Sinclair of Brabsterdorran, and as such was retoured heir to him on 2nd April 1772. This means John had to be a grandson, indicating that Francis had more children than St Clair's has recorded.

John, his wife Margaret, and their eldest son William, were granted a wadset of Brabsterdorran in 1670, by Henry Dundas.

Apparently had no male issue.

Due to the lack of a son and heir, John made a settement of his honours and estate in favour of his daughter's sons and their heirs; if those lines failed he stipulated his daughter's husband's brothers.
