NEWSPAPER ARTICLE: The North East Ensign, 6 Oct 1905, Benalla, Victoria, Australia.
Benalla Supreme Court
TUESDAY, OCTOBER 3.
(Before Mr Justice a'Beckett and juries of 12.)
AN ILLEGAL OPERATION.
Mary Bellears, a low-sized woman, wearing spectacles, aged about 32 years, with a soft face but common looking figure, and Frederick Kerslake, aged 44 years, a red-haired man with a Norwegian look about him and a low type of features, were presented on a charge of having feloniously and unlawfully acted in conjunction to procure abortion, the victim being Annie Harrison, daughter of a farmer residing in the district of Euroa.
Mr Leon prosecuted for the Crown. The prisoners pleaded not guilty, the male accused being defended by Mr Dawson, of Melbourne, the female prisoner being undefended.
The accused were convicted some time back on a similar charge and are at present undergoing sentences - the male prisoner a period of 2 years and the female 3 years.
Mr Leon, in opening the case for the Crown, said that the evidence which would be submitted to the jury would show that both prisoners played a part in the crime, as though it were an ordinary affair. The evidence he in tended putting forth was briefly this:
A young man named Thos. Boxall, a blacksmith, was keeping company with a girl named Annie Harrison. The result of the courtship was that the girl became enciente and one day as Kerslake was passing the shop where Boxall was working, Boxall told him he was in trouble and asked him if he knew of anything that would get him out of it. Kerslake told him, but said he would not guarantee it.
It was given a trial and proved resultless. Kerslake was again asked if he could get anybody to produce the desired result. Kerslake said he could and introduced the girl to Mrs Bellears, who agreed to procure a miscarriage for £5. After repeated visits to Bellears the purpose sought to be accomplished was effected and the sum referred to was paid. Both prisoners made state ments in writing to the police.
The confession of the female prisoner was that she committed, the crime and that all she got of the allowance for the illegal work done was 30s, Kerslake receiving the balance.
The total amount paid by Boxhall was £11. These admissions were made by the prisoner when she was originally arraigned for the offence some months ago, but she withdrew her plea of guilt before being presented at Benalla.
The statements of Kerslake, committed to writing as already stated, bore out all the Crown Prosecutor said in his opening remarks, the accused admitting introducing, the girl to Mrs Bellears foriIllegal purposes and accompanying the former to and from the latter's place after performance of the various operations.
Mr Dawson addressed the jury at some length on behalf of Kerslake, telling them to exclude from their minds the incriminating statements contained in the confession of Mrs Bellears. They were relevant facts against the latter only. He would like to know why Mrs Bellears had with drawn her plea of guilty which she made at Euroa. What inducements were held out to her? Was it done for the purpose of getting in, as against Kerslake, a long farago of dirty statements which would have a certain effect on the minds of the jury, even if they were told to pay no attention to it. Mr Dawson characterised Boxhall and Miss Harrison as despicable creatures whose evidence was worth-less.
His Honor, in summing up, said that if the jury believed the girl was brought to Mrs Bellears for the purpose stated and that the prisoners were associated for gain that is, if Kerslake was working in concert with Bellears he was guilty, but if they considered he only told Boxall where he could get the relief desired and merely mentioned Mrs Bellears as a person who could give it, he was not punishable by law.
'
The jury, after a short retirement, found both prisoners guilty. Kerslake was then sentenced to one year and Mrs Bellears to six months' imprisonment, both sentences to be cumulative on those which the accused are at present serving.
Kerslake is the father of a family of 12 and is said to have lived at Euroa 21 years, during which time he proved himself hardworking and honest.

A RESULT OF THE EUROA REVIVAL
BROTHER GEORGE HARRISON
Though only sixteen years old, this young comrade has constantly proved the grace of God sufficient to keep him from all sin since the day he knelt at the pentinent-form, seeking mercy. He says - "I had not gone far into sin, but was going. I was a bad swearer, though mother knew it not. I formed the habit of smoking cigarettes and mixed with bad company. My life has been happy since I came to Jesus, and I am sorry that I did not come before." It may be said of him that he was saved in time. Brother Harrison delights in giving a bold and open testimony for Jesus, and knows the value of his new-found Friend. Though working in the bush all the week he keeps a bright countenance.
His is all there at the meetings, adn startles the imagination and feelings by his originality and sound exhortations to the sinner.
A future of great and blessed usefulness is predicted to him. He is the sort of boy who is able to mark out his path in life, fix his calling, and pursue it.
May God give him the need grace!
